In March, 2022 the Department of Labor (DOL) issued Compliance Assistance Release (CAR) No. 2022-01 (Compliance Assistance Release 2022-01: 401(k) Plan Investments in “Cryptocurrencies.”)  The CAR is a sub-regulatory guidance about the DOL’s view on offering cryptocurrency as an investment option in 401(k) plans. Ordinarily, that would be seen as only the Department expressing a concern that it has.
